A framework agreement is a contract for future contracts. The buyer runs a procedure once and signs an agreement with one or several contractors. Then, when the need arises, it awards specific contracts under it.
Main rules
- Duration: up to 4 years for public buyers and up to 8 years for sector buyers.
- After it is signed, no new contractors can be added.
- The agreement is concluded after one of the usual procedures – open, public competition etc. Taking part in it is the only way to get into the agreement.
How the specific contracts are awarded
| Situation | How it is awarded |
|---|---|
| One contractor, all terms set | Directly on the terms of the agreement |
| One contractor, the terms are not complete | The buyer asks the contractor to complete its bid |
| Several contractors, the terms are not complete | Internal competitive selection among them |
| Several contractors, all terms set | Directly or by internal competitive selection, if the documents provide for it |
Internal competitive selection
The buyer sends a written invitation to the contractors under the agreement, sets a reasonable deadline for bids, appoints a committee and issues a decision.
> Law: The result of an internal competitive selection cannot be appealed if the total value awarded under the agreement is below €153,387.56 for works and below €51,129.19 for supplies and services (Art. 196(2) of the Public Procurement Act).
