This procedure is available only to sector buyers – companies in water supply, energy, transport and postal services. They may choose it freely, on a par with the open and restricted procedures (Art. 132 of the Public Procurement Act).
How it runs
- A call for competition (notice) is published.
- Candidates submit requests; the buyer selects.
- The invited candidates submit bids and the buyer negotiates with them.
- Decision on the contractor and contract.
Deadlines
| Stage | Minimum deadline |
|---|---|
| Requests to participate | 30 days (15 in urgency) |
| Bids | as agreed with the candidates; without an agreement – 10 days from the invitation |
In defence and security a similar procedure is negotiation with publication of a contract notice (Art. 160 of the Public Procurement Act), which follows the rules of the competitive procedure with negotiation.
Updated on 3 Oct 2026. General information, not legal advice. The Public Procurement Act, its implementing regulation and the tender documents prevail.
